Čoahkkáigeassu:In accordance with the provisions of article 67 of the Constitution of the Republic of Ecuador, the family is the fundamental nucleus of society and in such virtue requires protection by the State which, through the National Assembly, must legislate legal norms that develop family rights in compliance with the constitutional mandate. In the indicated article 67 at the constitutional text, different types of family are guaranteed, which are formed by a man and a woman with or without children, the facto unions, the families conformed by a father or by a mother with one or more children, these are the traditional families at which most Ecuadorians are part. With this background it is shown that with this investigation we will analyze the new forms of family, that is to say of the homoparental families, which are formed by two mothers or two fathers but with children, whose legal existence was recognized for the first time in Ecuador with Sentence No. 184-18-SEP-CC issued by the Constitutional Court. For such considerations, it is necessary to analyze in the investigation what are the limits and scope of the sentence issued by the Constitutional Court, in which cases it is applicable and above all it is so important to determine what are the rights of homoparental families that are infringed because of the lack of normative and regulation in both the Civil Code of Ecuador and the Code of Childhood and Adolescence, legal regulations that do not guarantee any right to these new forms of family, whose legal consequences we will try to evidence in this investigation.
