| Résumé: | This research analyzes how indictment information influences in de facto relationships, as an evidence to end them, in some processed trials at the Judicial Unit of the Family, Women, Children and Adolescents, from Riobamba canton, Chimborazo province, 2013-2014. This research is divided into five chapters. The First chapter talks about a Reference Framework. It shows the field research, its origin, its current situation and how it behaves itself. Then, its general and specific objectives are established in order to determine, if indictment information influences as an evidence to finish a De facto union. Also, this investigation is feasible, original and appropriate, as it is shown in its rationale. The Second chapter develops a literature view about approaches, theories, concepts, some bibliographic articles which come from some books, regulations, textbooks, laws; in other words, all of them refer to the theoretical framework. This chapter is divided into six units, including sub unit divisions. Specifically, the first unit talks about a family in the Ecuadorian society. The second unit refers to De facto unions. The third unit mentions judicial history about De facto unions. Unit four speaks of indictment information, as an evidence to prove something. The fifth unit emphasizes on indictment information and its impact on De facto union endings. The sixth unit presents studied cases related to De facto unions. The Third chapter presents its research development by using surveys. They were applied to lawyers who are not public employees. They answered a questionnaire which asked, if indictment information influences in De facto union trial terminations. This research contains the application of interviews to some judges from Adolescent, children, woman and family Unit, in Riobamba. The use of inductive and analytic methods was relevant when applying interviews. Particularly, the gathered information through interviews included inductive method analysis, which allowed to identify indictment information, as a direct influence in De facto union terminations. On the other hand, the analytic method allowed to get a critical and juridical analysis about different aspects, related to the research. All of them contributed to hypothesis verification. The fourth chapter displays some conclusions and recommendations, after analyzing and interpreting some charts and statistical figures. Excel was used in order for getting exact percentages about data processing. Besides, this is a descriptive investigation, because after tabulating, interpreting and processing data, the field research stays as it really is. Consequently, the final results kept the same context and behavior, as in the beginning of the research. Finally, the fifth chapter details the reviewed references, such as texts and their authors, which were cited on this research. It includes additional materials such as: laws, codes, regulations and websites. All of them contributed with relevant information, as a support to clarify particular points on the field research. |
