With the changes that society has had, new models of families are created, and state must seek their protection. At the global level, reforms have been made in their legal systems, accepting this new model of obtaining a divorce procedure, which has as its main characteristic that it is not necessary to show the reason before a judge so that it may issue a divorce decree, respecting the privacy of the spouses. Among the rights guaranteed by the Carta Magna of Ecuador are the rights to personal and family privacy, to the free development of personality rights that in a certain way are limited by the current divorce process in Ecuador, reiterating that it is the duty of the state respect and enforce the rights guaranteed in the Constitution. The divorce without cause is a more agile process that seeks to avoid a greater confrontation between the spouses and their families, so that the divorce process is concluded trying to create the least possible effect for family members. |
