At the global level, reforms have been made in their legal systems, accepting this new model of obtaining a divorce procedure, which has as its main characteristic that it is not necessary to show the reason before a judge so that it may issue a divorce decree, respecting the privacy of the spouses. Among the rights guaranteed by the Carta Magna of Ecuador are the rights to personal and family privacy, to the free development of personality rights that in a certain way are limited by the current divorce process in Ecuador, reiterating that it is the duty of the state respect and enforce the rights guaranteed in the Constitution. The divorce without cause is a more agile process that seeks to avoid a greater confrontation between the spouses and their families, so that the divorce process is concluded trying to create the least possible effect for family members. |

Con los cambios que ha tenido la sociedad se crean nuevos modelos de familias y el Estado debe procurar su protección, a nivel global se ha efectuado reformas en sus ordenamientos jurídicos acogiendo este nuevo modelo de procedimiento de obtener un divorcio, el cual tiene como característica principal que no es necesario exteriorizar los motivos ante un juez para que dicte sentencia de divorcio, respetando la intimidad de los cónyuges. Entre los derechos que garantiza la Carta Magna del Ecuador están el derecho a la intimidad personal y familiar, al libre desarrollo de la personalidad derechos que en cierta manera se encuentran limitados por el proceso actual de divorcio en el Ecuador, reiterando que es deber del Estado respetar y hacer respetar los derechos garantizados en la Constitución.
