La falta de práctica de la prueba en los juicios de alimentos y el interés superior del menor

ABSTRACT This research work is made up by three chapters. The first chapter refers to the study of the right process framed to the practice of documental evidence in Ecuadorian legislation, referring even to the procedural matter of the General Organic Code of Processes, as well as the procedural principles of the judge, within a judicial process. In the second chapter, the fundamental right of children’s best interests was analyzed and its interpretation within Ecuador, in the same way, the children’s right to maintenance was analyzed. In the third chapter, a legal analysis was carried out on the lack of evidence in maintenance proceedings, as well as the best interests of children, carrying out all these legal analyzes to determine if the lack of evidence affects the adequate development of the corresponding process, resulting in this investigation that, although it is true that there is no clash of rights to weigh them, it is necessary for the judges to act in favor of the best interests of children, as well as in strict observance of the right process, thus allowing the non-violation of the right process and attending to the legal protection of the children’s best interests.
