Ամփոփում:The Crime of hate acts is one of the legal figures that in recent years has had a lot of prominence within the judicial system, even more so when we talk about this Crime applied within secondary education establishments. This legal figure can be confused with the Crime of discriminatory acts since there are many similarities between the Crime of hate acts and the Crime of acts of discrimination, but that finally go by separate strings since the criminal type of each Crime is different. These crimes, as such, are typified within the Comprehensive Organic Criminal Code in articles 177 and 176, respectively, of our Ecuadorian legislation. Students enjoy fundamental rights that are typified within the Constitution of the Republic of Ecuador as well as within the Organic Law of Intercultural Education, these regulations being the ones that most detail the rights that safeguard this group of individuals and that, at the moment that these rights are restricted, they lacerate the integrity of the student, violating the legal right of equality. In our country, there have been several sentences for hate crimes. One of the best known is the case of the Cadet of the Eloy Alfaro Military School (ESMIL), Michael Arce, who was the victim of degrading treatment by his instructor within this educational institution. This situation was resolved in the National Court of Justice in a judgment favoring the victim. Hate crime also occurs in the educational system among members of these establishments in which the aggressors, through physical or psychological violence, attack other individuals due to their race, sex, religion, skin color, social status, etc.; The most recent case is the one that happened in the Sabanilla parish, in the Célica canton, in the province of Loja, during the 2018-2019 school year. Another case of hate crime raised in an educational establishment is the one that happened in the Alausí canton, Chimborazo province, the same one that, at the time of the development of this research project, is under prior investigation, for which sufficient elements of conviction must be gathered to continue with the process and issue a sentence if applicable.
