“El despido intempestivo de la mujer embarazada y sus efectos jurídicos, en las causas tramitadas en la Unidad Judicial Civil, con sede en el cantón Riobamba, en el período abril 2015 a septiembre 2016”

The present research project entitled "the untimely dismissal of pregnant women and their legal effects, in the cases processed in the Civil Judicial Unit, based in the canton Riobamba, from April 2015 to September 2016" focuses on analyzing the legal effects of untimely dismissal. This study contains a perception of the feminine gender from the constitutional, philosophical and legal point of view; Focused on the labor discrimination by the employer towards the working woman who, because of her condition as a pregnant woman, is limited to carrying out her activities leading to untimely dismissal. The legal effects stipulated in the law in accordance with international treaties and conventions ratified by Ecuador are analyzed below, in order to make known the appreciation they contain. This analysis is essential for the pregnant worker to maintain job stability and above all to keep her job or to be the case opts for a dignified and proportionate compensation to the fact. To conclude this project, it is necessary to go to the practical case. Being a very little known and applied legal figure, the process is analyzed, especially the judgment, where the competent judge maintains impartiality and respects legal certainty even though the worker fails to obtain compensation.
