Captación ilegal de dinero en Ecuador y sus consecuencias jurídicas y socioeconómicas.

Illegal money laundering is a crime against the financial system and therefore affects the national economy since financial activities in Ecuador are a public service and must be carried out with the authorization of the control entities. The objective of this research was to determine the legal characteristics of the crime of illegal money collection and its legal and socioeconomic consequences, through documentary-bibliographic research, applying a qualitative approach and using the legal-doctrinal, analytical, inductive, and descriptive method, with a survey of law and economics professionals based on the information obtained in the theoretical framework. Case law was used as a documentary-bibliographic source, studying case No. 17282-2017-0360, which does NOT constitute illegal money collection, and in contrast case No. 03282-2018-00300, which DOES constitute; and process No.18282-2021-01211 was studied. With the results, it is defined that financial crimes have a high degree of affectation. In conclusion, the illegal collection of money is mostly executed in an open pyramid scheme model, can cause losses to companies and workers, triggering poverty, distrust, and psycho-emotional and physical problems to the victims; it also weakens the national productive investment, makes savings more expensive and can even produce inflation; it also violates the rule of law in the legal field, and produces ineffectiveness of the repression mechanisms, including the victims are not fully compensated.
