| Shrnutí: | In this research work entitled: "THE ACTION OF REPETITION OF THE RELATIVES AGAINST THE MAIN DEBTOR IN THE RIGHT OF MAINTENANCE" The right to maintenance was made as a reference, in which parents as the first obligor or the family have a legal obligation to provide a children or teenagers support to ensure their integral development by defraying their personal expenses which come from their birth. In fact, parents are the ones who must bear the costs that involve the raising of their children, however, this is not always true, since there are factors such as: lack of work, death, physical impediment, or deprivation of liberty for an offense with an enforceable sentence that prevents the father from providing alimony, therefore the food action must be attempted to the other obligors to share the responsibility of maintenance. It is in this way that the Organic Code on Children and Adolescents establishes several obligors of food, who, despite not being child´s parents, the law attributes this character to them, which may be subsidiary, sharing, in many cases this obligation. However, it is possible to indicate that in most cases of the obligation of subsidiaries are not completely fair and that in fact the law establishes the possibility that the relatives who are affected with the payment of alimony can exercise a right of repetition against the father or the mother, so that these values are reimbursed to them. |
