La efectividad del apremio personal frente al derecho de alimentos en la unidad judicial de la familia, mujer, niñez y adolescencia en el cantón Riobamba.

ABSTRACT: This research project comprehensively analyses the right to maintenance in the Ecuadorian legal context, focusing on personal coercion as a coercive measure in the event of non-compliance with the obligation of the provider. From a doctrinal and legal perspective, it highlights the importance of personal coercion in the protection of fundamental rights, especially in the field of social law. The clarity achieved in the normative and conceptual aspects lays the foundations for an in-depth understanding of obligations and rights in maintenance relationships. Based on interviews conducted with judges of the Family, Women, Children and Adolescents Judicial Unit of the Canton of Riobamba, the research concludes by highlighting the complexity inherent in the application of personal duress and the need to balance its effectiveness with respect for the fundamental rights of the parties involved. The critical evaluation highlights challenges such as the lack of knowledge of the defendant's residence and departure from the country, and underlines the importance of considering alternatives to ensure the fulfilment of maintenance obligations without undermining fundamental rights. These conclusions provide valuable guidelines for improving the legal mechanisms, thus consolidating the effectiveness and equity of the legal system in the area of maintenance in the Judicial Unit for the Family, Women, Children and Adolescents of the canton of Riobamba.
