Estudio comparado de la mediación previo a un litigio individual de trabajo.

The present research is entitled: Comparative Study of mediation prior to individual labor litigation, whose purpose is to determine whether mediation would directly favor the reduction of the procedural burden of labor litigation, as is already the case in other countries of our continent, thus allowing the administration of justice to comply with its fundamental principles such as speed and efficiency. Indeed, mediation is a conflict resolution procedure by which the parties, assisted by a neutral third party called a mediator, seek a voluntary agreement on a negotiable matter, which puts an end to the conflict; this judicial tool is little known by society in general, its study will allow understanding the scope and advantages it provides. Methodologically, the type of research is inductive, deductive, exegetical, and comparative; its design will be a non-experimental documentary, the data collection technique was the survey, and the instrument was the dichotomous questionnaire used in a population of 10 professionals made up of: Judges of the Specialized Court of Civil, Commercial, Labor, Family, Childhood, Adolescence and Adolescent Offenders of the Provincial Court of Justice of Chimborazo, Officials of the Riobamba Mediation Center.
