| Tóm tắt: | This research is intended to analyze the legal characteristics of the irrevocability of voluntary recognition and its impact on the child´s right to identity in the Riobamba canton. In this context, the research will address the study of voluntary recognition that occurs when a man recognizes a minor knowing that he is not his biological father and the legal effects that this fact generates, among which the appearance of rights and obligations is highlighted mutual between the recognized minor and the father who legally recognizes him as his. Additionally, this research is based on the need to clearly establish the importance of recognition in the development of the child, for the noted parentofilial relationships and the emotional ties that the recognition determines; on the one hand, while, also, it is necessary to legally analyze the situation of the recognized minor with respect to the his biological father, especially when Art. 248 of the Civil Code determines that “Recognition is a free and voluntary act to the father or mother who recognizes. In all cases the recognition will be irrevocable; while the Comprehensive Criminal Code in is Article 211, regarding the suppression, alteration or assumption of identity and marital status, provides that the person who registers as their own, in the General Directorate of Civil Registry, Identification, and Certification to a person who is not your child will be punished with imprisonment for one to three years. |
