| Sammanfattning: | Free access to medicines is a right that in international and national legislation has been provided as a relevant component of the fundamental right to health; therefore, the Constitution of the Republic of Ecuador, in its precepts, contemplates the obligation of the State to comply with this responsibility, framed in certain principles such as universality and gratuity; also considering that its development and scope is currently found in constitutional jurisprudence. The current research aims to elaborate a legal-social study on the right to free access to medicines in Ecuador to establish whether the Ecuadorian State provides the necessary drugs to people for the timely and efficient treatment of their illnesses, guaranteeing their right to health; therefore, for its fulfillment and scope, an analysis of the conceptions, generalities, regulations, judicialization, and jurisprudence of the mentioned right has been carried out, as well as a study and determination of the mechanisms and figures that allow the State to guarantee it. A non-experimental design has been used, employing a documentary, field, and descriptive research, through the use of techniques and instruments like the survey, which was directed to people who treated in public health centers, and based on the inductive, legal doctrinal, legal analytical and legal comparison method. The transcendent result has been obtained that the public health system still violates this timely access to medicines. The results show that correlational conclusions and recommendations have been formulated to capture relevant information for the subject of study. |
