Ամփոփում:Ecuador being a State governed by written laws or known as substantive law, after an extensive debate it was achieved that the current General Organic Code of Processes came into force in 2016, replacing the Code of Civil Procedure and bringing certain procedural changes within the regulations governing the substantive Ecuadorian Civil Code; however, little can be found on the topic studied, since these laws focus more on dealing with alimony for minors and not congruent alimony for the benefit of adults; such is the case of the Organic Code of Childhood and Adolescence that stipulates in written form on the provision of alimony towards minors and in the COGEP it talks about the procedure to follow to make effective this inalienable right. In light of our research, there is the Organic Law of the Elderly, which clearly grants rights, benefits and even makes known the prohibitions that must be respected for being part of a priority group, but unfortunately, these laws do not have a deep approach in its content, thus allowing that rights are violated in the provision of congruent food, where it is evident the lack of equality for the payment of the thirteenth salary; Within the present investigation, it is taken as a reference, among other laws, the Madrid International Plan of Action on Aging, issued and discussed at the Second World Assembly on Aging, in Madrid-Spain, where it is exalted that the basis for the recognition of human rights find their reason in the dignity of the person, since dignity is an attribute of man as a rational being. Thus, the dignity of the person has an inalienable, inalienable and imprescriptible value, which is never lost by the subject of rights, this in accordance with our Constitution of the Republic of Ecuador.
