| description | SUMARY O ABSTRACT Constitution of the Republic of Ecuador promulgated in 2008 made significant progress in recognizing the adolescents' rights, including them within a group of priority attention and attributing a shared responsibility between the State, society, and the family to be protected, considering them as the future of our country. Due to the economic situation our country has is going through. Also, there is a large number of adolescent workers in precarious conditions. The Labor and the Childhood and Adolescence Codes have established that adolescents over 15 years of age are productive entities. They can sign employment contracts, care that the activities to be carried out do not obstruct their proper physical, psychological and educational training. The working adolescent will only be able to work 6 hours a day and five days a week without neglecting their academic activities. International and national regulations have recognized the right to education as a fundamental right of human beings, and it must be of quality and free. Adolescents who work should be encouraged by their parents and employers to continue with their academic life since only academic training will allow the adolescent to have better working conditions. This research allows establishing that even with the public policies implemented by the State. There is a violation of the right to education by the employers of adolescent workers, which forces them to carry out long hours, preventing them from attending educational centers or due to the entrusted activities and financial need to abandon their studies. Ana Maldonado León ENGLISH PROFESSOR C.C.0601975980 RESUMEN La Constitución de la República del Ecuador promulgada en el año 2008 realiza un avance importante al reconocimiento de los derechos de los adolescentes, incluyéndolos dentro de un grupo de atención prioritaria y atribuye una responsabilidad compartida entre el Estado, la sociedad y la familia para que los adolescentes sean protegidos, ya que el futuro del país está en manos de las próximas generaciones. Debido a la situación económica que atraviesa el país y a la gran cantidad de adolescentes trabajadores en condiciones precarias, el Código del Trabajo y el Código de la Niñez y adolescencia han establecido que los adolescentes mayores de 15 años sean entes productivos y puedan suscribir contratos de trabajo, precautelando que las actividades a realizar no obstruyan su correcto desarrollo físico, psicológico y formación educativa, es decir el adolescente trabajador únicamente podrá laborar 6 horas diarias y 5 días a la semana sin dejar de lado sus actividades académicas. El derecho a la educación ha sido reconocido por la normativa internacional y nacional como un derecho fundamental de los seres humanos y este debe ser de calidad y gratuito. Los adolescentes que trabajan deben ser impulsados por sus padres y empleadores a continuar con su vida académica, puesto que únicamente esta formación permitirá que el adolescente posea mejores condiciones de trabajo. La presente investigación permite establecer que aún con las políticas públicas implementadas por el Estado existe vulneración del derecho a la educación por parte de los empleadores de trabajadores adolescentes, los cuales les obligan a realizar jornadas extensas impidiéndoles asistir a centros educativos o por la responsabilidad de las actividades encomendadas y la necesidad económica deciden abandonar sus estudios.
