Crynodeb:In the Ecuadorian legislation, several advances have been presented in terms of rights for working women. However, some legal gaps are latent when applying the regulations in favor of women in pregnancy and lactation. For this reason, it is essential to analyze if, in fact, woman during breastfeeding period have job stability. Therefore, the legal rules on untimely dismissal during the breastfeeding period will be established; identifying, through comparative law in Latin America, if our country is at the forefront in terms of rights over this special protection group. In addition, this context will allow us to propose a reform to article 153 of the Labor Code in relation to the job stability of women during lactation. With the sole objective of contributing and protecting the welfare of hundreds of mother’s victims of discrimination during this period, important in the development of children and the proper performance of women in their roles.
