In Ecuador, companion animals are considered movable property under the Civil Code, which limits their recognition as sentient beings, leading to inadequate protection for their welfare and, consequently, restricting owners' ability to obtain fair compensation for the harm caused to them. Other countries in the region, such as Chile, Colombia, and Argentina, have made progress in recognizing animals as sentient beings, highlighting the need for a reform in Ecuador’s legal framework to align with international advancements and ensure better justice for affected owners. The civil liability of veterinarians lies in the obligation to provide appropriate care necessary to preserve the health of the animals under their responsibility. The significance of this research lies in providing a solid foundation for the reform of Ecuadorian legislation regarding the recognition of companion animals as sentient beings, rather than as movable property, as this would facilitate their inclusion in multi-species families and allow for more adequate legal protection. Additionally, this research aims to clarify the implications of civil liability for negligence or malpractice in veterinary practice, seeking to improve the protection of animal rights and enable affected owners to access fair compensation mechanisms that not only cover physical and material damages but also the emotional and psychological suffering experienced by the owners. |
