| Özet: | ABSTRACT: In recent years, the Napo province has witnessed a significant increase in mining activity and mineral extraction, however, in 2021 there was a notable increase in this activity in the communities of Jatunyacu and Yutzupino, which has resulted in a negative impact on local biodiversity, characterized by a decrease in water resources and contamination of adjacent rivers, as well as the loss of tourism opportunities for the inhabitants of these communities, who have seen the natural attractiveness of the region diminished due to deforestation. The objective of this research is to legally and doctrinally analyze the Ecuadorian legal framework on mining exploitation in order to determine the rights that are violated to nature in Napo province. As for the methodology used, we opted for the inductive, analytical, dogmatic and descriptive method, with a qualitative approach; given the nature of the research, the design was non-experimental; the population under study is constituted by legal professionals, including lawyers specialized in environmental law, officials of environmental entities and members of activist groups or communities in defense of environmental rights in the province. The results of the research show multiple violated rights, attributable to the mining exploitation that continues and is omnipresent in Napo province. |
