La legalidad de la prueba conseguida a través de la cámara de Gesell

ABSTRACT: This research work starts with a general analysis of the principle of legality as a fundamental pillar of the legal system, which allows us, after being introduced in the Ecuadorian penal system, more precisely in the evidentiary system, to verify its objectives through a detailed analysis of the Gesell Chamber, as one of the fundamental instruments of criminal investigation, thus examining its application, methodology and effectiveness in obtaining evidence, which allows us to establish advantages and disadvantages that, according to the general objective of the project, leads us to establish whether the principle of legality governs the obtaining of evidence obtained through the use of the Gesell Chamber. To achieve this task, it has been necessary to use a descriptive and qualitative methodology, developing a narrative-descriptive exploration of the problem to investigate; together with a systematic, flexible and methodological process, determining the qualities and characteristics based on the information gathered in the research process, with a mixed research approach, where the survey is used as a fundamental research instrument, which was conducted to a population of experts, allowing to determine the technical use of the Gesell Chamber in the Criminal Procedural System, finally finding the validity of the principle of legality.
