In many cases, they may suffer from double vulnerability since their degree of disability, added to their short or advanced age, prevent them from carrying out essential self-care activities. That is, your life and well-being depend on someone else. Even though is it up to those in their care and responsibility to receive special or reinforced protection, which indirectly ensures the full enjoyment and enjoyment of their rights to the person with disabilities, the security of their rights must have a progressive development. Avoid transgressing the labor of these workers since it is possible to conclude, based on the pronouncements that the constitutional court has made through its sentences, that those substitute workers are covered by the guarantee of reinforced job stability, which implies their permanence in a job as a protective measure. When the job stability of these workers is unjustifiably violated, it is up to this worker to return to his position since the compensation established by the rule must proceed in the last of the cases when he can't be reinstated. The aim of this work, qualitative research, was to establish the problem's qualities or characteristics and to determine if it complies with the hypothesis raised. Bibliographic research is used to construct the theoretical framework to access primary sources of information such as codes, laws, regulations, agreements, legal doctrine and jurisprudence. |
