Résumé:This research project entitled "Commercial ventures in the city of Riobamba and brand law" entrepreneurship is an updated global term nowadays, which today has become a topic of great importance for governments because it plays a significant role in employing a relatively lower cost than large industries. The objective is to determine the legal reality of the commercial ventures of the city of Riobamba and the brand rights that their products possess. Therefore, the analysis unit was located in the city of Riobamba, in which research methods were applied, such as the legal-doctrinal method, legal-analytical method as well as the inductive and descriptive method in which a quantitative approach was applied. As a result of the legal reality of their commercial enterprises and the brand rights that their products possess, where it was possible to show that the entrepreneurs surveyed made it known that it is important to know the legal requirements to be able to undertake or start a business. Concluding that the registration of a trademark refers to the protection of something of its own, this means that third parties cannot use it unless it is authorized by the person who registered said trademark since, on certain occasions, many enterprises believe that placing a name similar to a commercial brand will help them to have customers. However, they are unaware that by doing so, they are committing a crime and being penalized according to various regulations such as the Intellectual Property Rights Regulation.
