Итог:This study examines the phenomenon of vicarious violence as a distinct form of genderbased violence, with a particular focus on its legal implications within the context of the Ecuadorian legal system. A comparative law analysis between Ecuador, Spain, and Mexico, employing a qualitative methodology comprising legal analysis, expert interviews, and case studies, reveals a dearth of specific criminalization of vicarious violence in Ecuador. The findings demonstrate that this form of violence, defined by the utilization of children to inflict harm upon the mother, has significant ramifications for child development and serves to perpetuate cycles of intergenerational violence. The comparative analysis emphasizes the necessity for implementing specific legal frameworks, as exemplified by those in place in Spain. It concludes that the absence of such legislation in Ecuador creates a legal vacuum that hinders the effective protection of victims and the punishment of aggressors, thereby underscoring the urgency of addressing this problem within the Ecuadorian legal framework.
