| 要約: | The Constitution of the Republic of Ecuador establishes several applicable principles in terms of labor law, being one of the most important that states that worker´s rights are inalienable, that is to say that neither at the worker´s express request can his rights be waived; and, on the other hand, this principle requires thee employer observes and respects labor rights during the entire time of the employment relationship , Consequently , it is stated , the present research several acts are studied at the beginning, during and, at the end of the employment relationship. They are characterized by transgressing the worker´s rights these acts are known as labor fraud and labor procedural fraud . In this regard, it is indicated that in Ecuador there is no specific regulation that protects workers against acts of labor fraud , which are presented in daily practice, such as when the employer to an employment relationship, he tries to disguise for a civil or commercial relationship to evade his employer obligations. Likewise, the employer executes the acts of labor procedural fraud when it makes him subscribe to the worker in a compulsory , but not voluntary, resignation , bills of exchange and other blank documents , so they can be filled when the employer requires , to disassociate the worker , or make presume that their rights were already paid in full, when in reality it is the opposite. Whit this background , it is stated that the acts of labor and procedural labor fraud are not specifically regulated in the Labor Code of Ecuador , it is necessary to deepen this research topic from the academy, in order to the workers know and better protect their rights , against certain employers who try to benefit illegitimately from them. |
