In the second chapter, the theoretical framework is presented and information is presented on a comparative research study regarding crimes, penalties, and sanctions and the issues of rules and time in each area of concern. This project is divided into three units. Unit I covers the main theme and the prescriptions and subdivisions relative to the issue of penalty. Unit II examines the issues of time and action relative to particular crimes. Unit III presents the issues of time and penalty in crimes and their relationship to contraventions typified in the Penal Code and that are currently found in the COIP. The third chapter discusses the methodological framework of the research study and presents the qualitative, deductive, analytical, historical, descriptive, explanatory, longitudinal, and comparative methods used in the study. The fourth chapter presents the administrative framework and the conclusions and recommendations of the studyEl presente trabajo investigativo está dividido en cuatro capítulos, el primer capítulo habla sobre el marco referencial, donde se va a tratar la introducción; el planteamiento del problema; justificación e importancia; los objetivos generales y específicos, donde observamos que la investigación es factible novedoso y original, que servirá para los abogados, estudiantes de la carrera de derecho y la ciudadanía en general. En el segundo capítulo se desarrolla el marco teórico, donde se realizó un estudio comparativo sobre los delitos que existían y existen; en que artículo estaban tipificados y donde se encuentran en la actualidad; la pena con las que se sancionaban y las que ahora se imponen; y, sobre todo que reglas se utilizaban y las que se emplean para calcular en que tiempo prescribe la acción cuando no se ha iniciado el proceso, cuando si se ha iniciado; y por último en cuanto tiempo prescribe la pena. Este proyecto está dividido en dos secciones, la primera, abarca el tema principal que es la prescripción y su subdivisión que es la prescripción de la acción y la prescripción de la pena; la segunda sección, se desarrolla en el cuadro principal donde se calcula y establece los tiempos en los que prescribe la acción y la pena en delitos como en contravenciones que estaban tipificados en el Código Penal y que están en la actualidad en el COIP. El tercer capítulo habla sobre el marco metodológico, en donde se explica que en la presente investigación se utilizó los métodos: cualitativos, deductivos, analítico, histórico, descriptivo, explicativo, longitudinal y comparado. Se llega a un resultado y se realiza una discusión.
