| Sumari: | ABSTRACT: This research conducts an analysis of the criminal justice system in the face of serial murder cases in Ecuador and comparative law. The study starts with the idea that the lack of recognition and proper categorization of serial murder within the “Código Orgánico Integral Penal” influences the state's ability to prevent and solve this type of crime effectively. Thus, it seeks to identify deficiencies and best practices in handling these cases, contributing to a more effective justice system, and guaranteeing a fair and adequate response to this extremely complex form of crime. As a result, this thesis was created with the primary goal of analyzing the Ecuadorian criminal justice system in terms of the investigation and punishment of crimes committed by serial killers using a documentary, bibliographic, legal, doctrinal, and case study to determine the need for its autonomous classification in the "Código Orgánico Integral Penal." A methodology was developed using a hybrid approach, and the survey technique was used with judges and legal experts in criminal cases. The theoretical framework was mostly based on a review of publications, books, news, and court decisions on serial murder cases in Ecuador and other countries. The lack of classification for serial murder produces imprecision in the treatment of these cases, making it difficult to properly prosecute and punish these criminals. Additionally, the study of literature, specific cases, doctrine, and experiences from various international systems has emphasized the need to classify this crime independently and implement investigative techniques such as the elaboration of criminal profiles to facilitate the identification of the modus operandi of these individuals.
