| description | ABSTRACT The title of this research is "THE TRIAL IN ABSENCE AND THE IMPUNITY OF THE CRIME OF TRAFFICKING OF INFLUENCES," it has originated as a social practice of corruption, the factors are diverse, but the most common is the search for one's benefit or stranger, who performs it out of favoritism. In this regard, the purpose of this investigation is to describe the impunity generated by the non-prosecution in the absence of the accused regarding the crime of influence peddling, which puts legal security at risk by not being able to reach the trial of the persons prosecuted for being fugitives of justice. For compliance, this investigation has three parts: first by treating the consistent theoretical framework in 3 units called: the first, influence peddling, the second, referring to impunity for the crime of influence peddling, and the third on trial in absentia and impunity for the crime of influence peddling. The methodological design is suitable for a social, legal investigation through the logical-inductive, analytical, and interpretive research method; qualitative research approach; bibliographic and descriptive documentary research; non-experimental research design. Additionally, information has been collected thanks to the research instruments, with which it has been possible to raise conclusions and recommendations according to the problem investigated. Ana Maldonado León ENGLISH PROFESSOR C.I.0601975980RESUMEN La presente investigación lleva como título “EL JUZGAMIENTO EN AUSENCIA Y LA IMPUNIDAD DEL DELITO DE TRÁFICO DE INFLUENCIAS”, se ha originado como una práctica social de corrupción, los factores son diversos, pero el más común, es la búsqueda de un beneficio propio o ajeno, que se lo realiza por favoritismo. En tal virtud, el propósito de la presente investigación, describir la impunidad que genera el no juzgamiento en ausencia del procesado respecto al delito tráfico de influencias, que pone en riesgo la seguridad jurídica al no poder alcanzar el juzgamiento a las personas procesadas por encontrarse prófugos de la justicia. Para el cumplimento la investigación se desarrolló en tres partes: primero mediante el tratamiento del marco teórico constante en 3 unidades denominadas: la primera, el tráfico de influencias, la segunda, referente a la impunidad del delito de tráfico de influencias, y, la tercer sobre el juzgamiento en ausencia y la impunidad del delito de tráfico de influencias. El diseño metodológico adecuada a una investigación jurídico social, a través del método de investigación lógico- inductivo, analítica e interpretativa; enfoque de la investigación cualitativo; tipos de investigación documental bibliográfica y descriptiva; diseño de investigación no experimental.
