La valoración de la prueba testimonial y sus efectos jurídicos en las sentencias dictadas en los juicios de divorcio por la causal de abandono injustificado de cualquiera de los cónyuges, tramitados en la unidad judicial primera de la familia, mujer, niñez y adolescencia del cantón Riobamba durante el periodo 2015.

The purpose of the research aims to generate justice operators of our country, in order to give legal value in the testimonial evidence affírmed about facts or circumstances by the procedural parties in divorce proceedings for the cause of unjustified abandonment of either spouses. Also, this investigation aims to investígate how the testimonial evidence affects the judgements of divorce proceeding because of numeral 9, 110 article of the Civil Code:” The unjustified abandonment of any of the spouses for more than six uninterrupted months” and in a primordial way to establish if the testimonial evidence id sufficient this casual, and guarantees to obtain the dissolution of the marriage bond. This is the reason why it requires a deep analysis that admits the exercise and success of a project itself that is structured in chapters divides as: The first chapter includes the Referential framework, which includes the Problem Approach, Problem Formulation Objectives, Justification and Importance of the Thesis Topic. The second chapter titled Theoretical Framework, the topic and the object of the thesis is outlined from the theoretical part, which has four units that refers to the hypothetical perimeter of the research, with the following subdivisions: Marriage and Family, Divorce, The Assessment of testimonial evidence in divorce proceedings for the cause of unjustified abandonment of either spouses, The Legal Effects of divorce proceedings for the cause of unjustified abandonment of either spouses, which is the Dependent variable object of the investigation and analysis of the present thesis, within each of the mentioned subtopics we will find the main concepts, theories, doctrines and the different legal norms that allowed to develop the present investigative work, and finally the fifth unit referring to The hypothetical unit.
