| Résumé: | The Kichwa nationality of the province of Orellana applies its customary law with the members of its community to correct behaviors legally sanctioned and rejected by the good customs among its inhabitants; it applies sanctions such as the application of chili, tobacco, nettle, guayusa leaf, among others; the research focuses on the respect for the right to personal integrity in the customary procedures applied to resolve their conflicts in the Kichwa nationality of the province of Orellana. The research analysis is applied in the province of Orellana, where the customary procedures applied by this culture for the resolution of internal conflicts were studied; the inductive, legal analytical, historical-logical, and legal descriptive methods were used, the type of research is essential or pure, dogmatic, historical-legal, field and legal descriptive, the approach is qualitative, of non-experimental design, authorities constitute the population, indigenous leaders and judges, the sampling is non-probabilistic. The sample consists of twenty-five authorities and indigenous leaders. Five judges of the province object of the research, the technique for data collection is the survey, and the technique for data processing is computer, logic, and mathematics. The results of the research show that the customary procedures applied by the Kichwa nationality are part of their cultural identity and do not violate the right to personal integrity of those who are executed since the objective is to correct, purify the body and cause reflection and repentance in the punished indigenous as a method to maintain harmony among its members. |
