La política criminal contra la corrupción y su normativa legal en el Derecho Comparado

ABSTRACT: Criminal policy, a set of state actions, provides citizen security to rights holders; however, in Ecuador, these actions to prevent and eradicate corruption in the public and private sectors are still non-existent, causing a serious economic impact in the country and as a result a detriment to the fulfillment and execution of the rights of good living. Therefore, the main objective of the present investigation is to analyze the criminal policy against corruption that is applied in our country to know how it affects the development of the State and consecutively compare it with different legislations; the unit of analysis is located in the Republic of Ecuador, specifically in the city of Riobamba, Chimborazo Province, where the criminal policy against corruption was studied, a qualitative approach was applied, the research is of a bibliographic, dogmatic, descriptive legal, legal analytical type of non-experimental design. The inductive legal, doctrinal legal analytical, and descriptive legal methods were applied to study the legal problem. The population is made up of judges from the criminal judicial unit and lawyers in free practice who were interviewed, and as a result, it was determined that in Ecuador, there is no adequate criminal policy that combats and ends corruption, which is why it is recommended to review the current legal regulations.
