| Shrnutí: | ABSTRACT CO2 pollution generated by public transportation is a growing problem that affects air quality and the health of citizens in Riobamba. This study seeks to analyze the regulatory regulation of the municipal GAD regarding this issue and its relationship with the right to a healthy environment. The main objective is to analyze the regulatory regulation of the GADM of Riobamba regarding CO2 pollution and the right to a healthy environment of citizens. Methods such as historical-logical, legal-doctrinal, legal-analytical, inductive, analytical and descriptive were used. The research is basic, documentary-bibliographic, field, analytical and descriptive. Surveys were applied to a sample of 20 officials from the mobility department of the Municipality of Riobamba. The legal analysis revealed the absence of legally established regulation to control CO2 emissions in Riobamba. The surveys showed a general lack of knowledge about environmental legislation and a lack of interest in implementing projects to address the problem. A lack of environmental culture was identified in the population, which hinders the ability of individuals to assert their right to a healthy environment. It is concluded that there is a violation of the right to a healthy environment attributable to the deficient regulations of the GADM of Riobamba. It is necessary to review and update the provisions to effectively mitigate CO2 emissions, develop an environmental education plan, promote a proactive role of the authorities and regulate regulations following examples from other cities. It is recommended to strengthen legislation and promote environmental awareness to guarantee the right to a healthy environment in the face of CO2 pollution from public transportation in Riobamba. |
