Crynodeb:The emergence of information technologies and digitalization has transformed the way contracts are concluded and transactions are carried out, giving rise to the growing use of smart contracts. However, in Ecuador, the lack of a clear legal framework creates legal uncertainty and vulnerability for users. This research aims to analyze the legal and regulatory implications of smart contracts in the civil sphere, with the purpose of proposing a robust legal framework that guarantees legal security and promotes the responsible use of these emerging technologies. A qualitative and legal analysis was conducted, reviewing national and international literature and doctrine, analyzing relevant case studies and comparative regulations. The results show that the validity and legal effectiveness of smart contracts depend on the establishment of a robust legal framework and the implementation of cybersecurity measures that safeguard the rights of the parties. It is concluded that smart contracts require specific regulation, with the provisions updated to reflect today's society.
