Las medidas cautelares personales y su incidencia Jurídica en el acusado en los delitos de Tránsito por muerte, tramitados en la Unidad Judicial Penal del cantón Riobamba, período enero a octubre del 2014.

One of the big inconveniences in the country is the great number of existent and changing laws that you/they confuse their application, this causes a misinformation an incorrect attention of the norm going in damage people that are involved in a fair or unfair way. This investigation is motivated by the continuous change of Juridical norms in the Ecuadorian penal system, the supposed disappearance of the law of “Transporte Terrestre, Tránsito y Seguridad Vial” for the COIP and the possible consequences that have generated or that they could generate in the defendant between these and other concerrns are present in this work. Every day we have accidents in the roads of our country and they are few the times that is known that it generates the later punishable fact to the assault, which are the juridical consequences that confront those involved, and there of the objective of this research work that looks for clarify the problem with respect to the existent reformations in the penal legislation and inside these changes, which refers to measures of personal constraint being taken in these cases. The problem investigated in the Criminal Justice Unit of Riobamba city unravels the difficulty concerning the legal status of the individual presumably responsible for a crime death on transit, What happens when it leaks shirking its responsibility?, What happens to the continuity of the process? And also with respect to the payment of its financial liabilities.
