Izvleček:The research focuses on the State's powers regarding contractual freedom in the reverse electronic auction procedure in Ecuadorian public procurement. The objective is to analyze how the State's powers impact contractual freedom in reverse electronic auction procedures and propose mechanisms ensuring legal security and fairness. The research adopts a qualitative approach, including an exhaustive literature review to conceptualize the topics addressed, an examination of the legal-doctrinal framework, including the Ley Organica del Sistema Nacional de Contratacion Publica, its Regulations, and supplementary norms, a comparative law analysis between the legislations of Ecuador, Colombia, and Chile, and interviews with professionals specialized in public procurement analyzed using Atlas TI. The research highlights that the exorbitant powers of the State in reverse electronic auction procedures, although necessary, create an asymmetry in the contractual relationship, placing the contractor at a disadvantage and generating legal insecurity. Standardized contracts do not contemplate the particularities of each procedure, exacerbating the perception of inequity and limiting contractual freedom. The research concludes that protective mechanisms that guarantee legal security and fairness for contractors in reverse electronic auction procedures are necessary. This includes explicitly recognizing the rights of contractors and balancing the powers of the State to avoid abuses and arbitrariness, thus improving efficiency and transparency in public procurement.
