ABSTRACT: This research work allows us to know if it fits the right of recourse against the sentence issued by the Inter-American Court of Human Rights in the case of (Quintana Coello and others vs Ecuador). Our constitution is guarantor of rights therefore the law should not be contrary to it. The population involved in the research process are 26 lawyers who have free exercise respondent to test the hypothesis. This research is characterized as an experimental research, exploratory, descriptive and explanatory; the results of the problem are based on the analysis, interpretation whereby the right of recourse is effective to recover the money that the Ecuadorian State has paid to the victims in this case. The research consists of chapters IV, Chapter I develops the frame of reference in which the problem allusion is made, the objectives to be achieved with the investigation; Chapter II units raised in the project, doctrinaire and critically, is developed based on the variables of the problem, Chapter III contains the methodological framework, the scientific method, the type of research, design notes research, the population involved, techniques and tools applied in this investigation, analysis and discussion of results is done and finally checking the hypothesis if we reject, accept or null; Chapter IV the conclusions and recommendations resulting from the investigation and analysis of doctrinaire set. |
