The specific objectives that will materialize the general objective are: to determine throughout a critical analysis the axes of treatment of the National System of Social Rehabilitation, analyze the requirements that a deprived person of liberty must have in order to adopt the penitentiary benefit and analyze the penitentiary benefits of the semi¬open regime in the social and labor environment. In the Chapter II is stipulated the theoretical framework structured by sub-themes that cover the legal support for the development of the research. The first sub-theme is the state of the art that is based on collecting research papers related to the theme, the second sub-theme is subdivided into four units known as theoretical aspects that contains the thematical subject of the present study. In the First Unit it is studied the axes of treatment of the National System of Social Rehabilitation that are labor; Education, culture and sport, health; Familiar-social bonding and reintegration. El Capítulo I, contiene dentro del marco referencial el planteamiento del problema, la justificación y se precisan los objetivos de la investigación. El objetivo general es describir como inciden los ejes de tratamiento en la obtención del beneficio penitenciario de régimen semiabierto del Sistema Nacional de Rehabilitación Social, durante el período de marzo a septiembre de 2016, en la Unidad Judicial Penal, con sede en el cantón Riobamba. Los objetivos específicos que materializarán al objetivo general son: determinar mediante un análisis crítico los ejes de tratamiento del Sistema Nacional de Rehabilitación Social; analizar los requerimientos que debe tener una persona privada de la libertad para poder acogerse al beneficio penitenciario y analizar los beneficios penitenciarios del régimen semiabierto en el ámbito social y laboral. Dentro del Capítulo II, se encuentra el marco teórico organizado por subtemas que contiene la normativa jurídica para el desarrollo del trabajo. El primer subtema es el estado del arte que se basa en recopilar trabajos investigativos con relación al tema, el segundo subtema se subdivide en cuatro unidades conocidos como aspectos teóricos que contienen lo que cada uno de los aspectos son. En la Primera Unidad se especifican los ejes de tratamiento del Sistema Nacional de Rehabilitación Social que son laboral; educación, cultura y deporte, salud; vinculación familiar - social y reinserción. La Segunda Unidad abarca que es el régimen semiabierto, los requisitos que exige la ley para que una persona privada de la libertad pueda acceder a este beneficio penitenciario y como se lleva a cabo la audiencia. En la Tercera Unidad se analiza los beneficios penitenciarios del régimen semiabierto en el ámbito social y laboral con el fin de determinar cómo los privados de la libertad a los que se les concedió el cambio de régimen de cerrado a semiabierto fueron tratados por la sociedad al momento de ser reinsertados y si lograron desempeñar algún oficio o profesión adquiridos en el centro de privación de la libertad en el ámbito laboral. La Cuarta Unidad trata sobre la diferencia entre régimen cerrado, semiabierto y abierto para poder distinguir los diferentes regímenes que establece el Código Orgánico Integral Penal y de esta manera dar a conocer los diferentes requisitos para uno de los regímenes.
