| الملخص: | This research has been developed through a systematic process that contains a qualitative, methodological approach; and, with the application of the inductive, analytical and descriptive methods, it has been possible to determine all the particularities of the crime typified in article 370 of the Integral Organic Criminal Code that refers specifically to the illicit association, where we analyze its conceptualization, interpretation, development and penalty within the law, all this has been carried out with an arduous study and the collaboration of justice operators such as judges, prosecutors, criminal lawyers, professors and other scholars of the subject, through their personal opinions and theoretical positions. It is analyzed how the offense of illicit association develops in practice, if it is done as an independent infraction or in a subsidiary manner at the time of committing another offense. The present research project consists of summary and introduction, to be divided into four chapters; the first contains the approach to the problem, justification and objectives; in the second chapter is the theoretical framework and state of the art related to the subject where all the legal and doctrinal study that was done is discussed; In chapter three we find the methodological framework, a methodology that also shows the field work and its results and discussion; finally, chapter four contains the conclusions and recommendations that are complemented with each other, as well as bibliographical references, appendix and annexes |
