| Shrnutí: | This research refers to the protection of the labor rights of pregnant or breastfeeding women in the public sector, highlighting that our Constitution and International Treaties ratified by Ecuador recognize and guarantee these fundamental rights; the objective of this research is oriented to identify the recognized constitutional rights of the working woman associated with her condition of pregnancy and breastfeeding period, in order to avoid the violation of these rights, and thus ensure their effective protection, is supported by descriptive and documentary bibliographic research, the same that led us to demonstrate the hypothesis put forward: given that it has been proven that the legal ignorance on the part of the appointing authority when applying Art. Lit. h, of the General Regulations to the Organic Law of the Public Service and terminating a contract of occasional services to a pregnant or breastfeeding woman, is detrimental to the effective protection of this priority group and their rights recognized in our Constitution. |
