| Summary: | The Ecuadorian criminal justice system faces a recurring issue: the ineffective application of the principle of procedural speed, which negatively impacts the guarantee of due process. The failure to comply with the procedural deadlines established in current regulations results in undue delays, affecting the right to effective judicial protection and the presumption of innocence of defendants. To address this research, a qualitative approach will be adopted, using a descriptive design based on the analysis of legal regulations, doctrine, and relevant cases. The inductivedeductive method will be used to identify patterns in the administration of criminal justice, and the analytical-synthetic method will be applied to evaluate the impact of procedural delays. As a solution to this problem, the modernization of the judicial system is proposed through the implementation of technological tools that optimize procedural management, continuous training of justice operators, and normative reforms to establish stricter sanctions for non-compliance with procedural deadlines. Additionally, the optimization of human and logistical resources is suggested to reduce case backlog and ensure timely and equitable access to criminal justice. |
