| Summary: | This study examines the responsibility of the Ecuadorian State following the declaration of an internal armed conflict through Executive Decree 111/2024, assessing its constitutionality and alignment with international standards. It evaluates whether the application of Protocol II of the Geneva Conventions to criminal groups meets the requirements of a noninternational armed conflict, given their lack of territorial control and hierarchical structure. Using inductive-deductive methods and jurisprudential analysis, tensions between the militarization of security, constitutional guarantees, and obligations under International Human Rights Law (IHRL) are examined. The study concludes that the declaration risks systematic violations, such as disproportionate use of force and criminalization of protest, while questioning the suitability of International Humanitarian Law (IHL) in narco-violence contexts. The Constitutional Court’s validation of the decree without examining the groups’ belligerent status exposes the State to international accountability before the Inter-American Court of Human Rights. Strengthening oversight mechanisms and aligning military operations with proportionality and human rights principles are recommended. |
