要約:The 2008 Constitution of Ecuador recognizes the rights of indigenous peoples and therefore the State is obliged to adopt special measures to guarantee the effective enjoyment of human rights and indigenous rights. However, discrimination and exclusion continue to affect them disproportionately in comparison with other sectors of Ecuadorian society. An investigation was carried out with the purpose of identifying the specific tensions that arose in the “Sarayaku” case as a result of the lack of knowledge of justice operators of the national and international legal instruments that protect the rights of indigenous peoples. The methodological approach was qualitative, as it allowed for an analysis of the June 27, 2012 judgment of the Inter-American Court of Human Rights (IACHR) 245, Pueblo Kichwa Sarayaku Vs. Ecuador; as well as several international and national legal instruments. Likewise, a quantitative modality was applied to obtain statistics related to the object of study. The type of research was descriptive with a documentary and field design. The sample consisted of 25 members of the Sarayaku people and 25 public officials from Quito, to whom a questionnaire was administered. The results showed that oil exploitation in the Sarayaku people violated human, environmental and constitutional rights.
