Zusammenfassung:This article examines the participation of notaries in Ecuador's inheritance proceedings, emphasizing their influence on the legality and efficiency of these processes. The main purpose is to analyze how notarial involvement ensures legal security and procedural effectiveness. Employing a qualitative methodology with exploratory, descriptive, and analytical components, the research is grounded in current legal frameworks and insights from interviews with notaries, attorneys, and heirs. The results reveal issues such as insufficient notification to heirs and the absence of a centralized digital registry for wills, which lead to delays and potential disputes. To address these challenges, the implementation of a centralized and digitized will registry is proposed as a solution to streamline the process and ensure greater transparency. The conclusion of this study highlights that a more proactive and organized role for notaries could significantly improve the management of succession proceedings in Ecuador, taking inspiration from practices in countries like Colombia and Mexico, where notarial systems are more dynamic and effective in handling such cases.
