Compliance penal y responsabilidad penal de las personas jurídicas

In recent years the figure of compliance has excelled in the business environment mainly in the economic and legal fields, due to its complex system of effective compliance program in the development of companies and organizations whose objective is to avoid financial risks and criminal sanctions. In Ecuador, the compliance system is not yet relevant applicable to the business sector and much less recognized in the Ecuadorian criminal legislation as such. For this reason, this paper will provide an analysis of the main characteristics of the implementation of compliance programs, highlighting the undeniable importance and advantages of adapting a compliance system at the corporate level, in turn seeks to provide a critical study of the criminal liability of legal entities based on the Ecuadorian Organic Integral Criminal Code and how compliance can act as mitigating and even exempting from criminal liability, when organizations adopt a comprehensive and effective system of criminal compliance programs that promote corporate culture. In addition, jointly analyze the criminal liability of legal persons to have an individual and own system of self-regulation based on the conduct of companies and agents of prevention processes and highlight how for them it is necessary to implement control and compliance programs that promote compliance and corporate culture and also ensure the sustainability and long-term success of the company based on ethics and responsibility.
