إضافة وسم | الملخص: | The objective of this article is the legal analysis of the crime of rape within Ecuadorian legislation and the differential treatment regarding the right to sexual and reproductive integrity of man (male), focused on the different circumstances that could configure this crime, taking into account, both, the dogmatic and legal professionals criteria, for which it will be determined if there is or not a violation of the aforementioned right by the State. Also, the Ecuadorian legislation will be analyzed as an axis point to know the scope of the protection of the right to sexual and reproductive integrity of men. As a line of research, the following has been selected: challenges, perspectives and improvement of Criminal Law and Criminology in Ecuador - Protection legally supervised assets. It is important to mention that the qualitative method will be used in this research since it is based on the description of the objects that are studied, as well as a cross-sectional diagnosis with the main perspective of tran sforming and improving the Ecuadorian legislation, through interviews with specialists, professionals, judges and prosecutors who will give us a vision from their legal and practical criteria, for a better analysis of the issue raised. |
