Yhteenveto:The issue of this study lies in the discretionary application of the Merit Control, which must balance the need for a thorough and substantive review of judicial decisions with the preservation of the stability and predictability of the legal system. The objective of the research was to analyze how the Merit Control influenced the protection of Legal Security, evaluating the effectiveness of the mechanism in ensuring that judicial decisions were reviewed in a fair and equitable manner, and ensuring the stability and predictability of the legal system. The methodology used was qualitative, with a non-experimental cross-sectional design, using analytical-synthetic methods, comparative law, and semistructured interviews with experts. The main result showed that the Merit Control strengthened Legal Security by allowing a thorough review of judicial decisions and the facts of the case, although its discretionary application presented risks of arbitrariness and inconsistencies. The main conclusion indicated that, although the Merit Control is crucial for the protection of fundamental rights and Legal Security, its inconsistent application could destabilize the legal order, thus highlighting the need to establish clearer and more objective criteria for its application, ensuring a fair and effective review that does not undermine the stability of the judicial system.
