| Тойм: | The credit card is a financial tool used worldwide. In Ecuador, it is protected as a payment method under the Organic Monetary and Financial Code. When a cardholder fails to settle debts incurred from credit card use, the bank initiates judicial processes to recover the portfolio. This research addresses the issue of which legal action or judicial procedure is appropriate for credit card debt collection, such as the monitoring or executive procedure. The objective of this scientific article is to determine the legal criteria applicable to judicial procedures for credit card debt collection and to analyze the effectiveness of these mechanisms in determining the most suitable process to follow in such cases. The methodology employed is based on a mixed approach with a descriptive and explanatory design, featuring an analytical-synthetic and inductive-deductive study. Additionally, it included an exegetical approach and case studies. Interviews were conducted to collect data, allowing the identification of the criteria judges use to admit or reject claims filed under the monitoring and executive procedures. The findings indicate that both procedures are legally correct; however, judges' perspectives often depend on the circumstances of each case. |
