Ամփոփում:The thesis addresses the need to reform article 222 of the Comprehensive Organic Criminal Code (COIP) of Ecuador, focusing its analysis on current sanctions and their impact on the prison population. The growing concern about the disproportionality of these penalties and their inadequacy to promote the social reintegration of offenders is highlighted. The main objective is to propose a reform that adjusts the sanctions to the principles of proportionality and social reintegration, thus ensuring their suitability to the needs of the Ecuadorian justice system. A qualitative and quantitative methodology was used, through surveys of justice managers and the comparison of the provisions of the COIP with international legislation, identifying good practices. The results reveal dissatisfaction with the application of current sanctions, with a recognition that these do not reflect the seriousness of the crime or contribute effectively to social reintegration. The research concludes that a reform of article 222 is essential to balance justice and human rights. This reform will allow for proportional penalties, thereby improving public confidence in the judicial system. The proposal includes a redefinition of sanctions, emphasizing both their deterrent nature and their ability to foster the rehabilitation and reintegration of offenders into society, promoting a more just and effective justice system.
