The methodology applied was primarily and qualitative, through the analysis of doctrinal and jurisprudential documents. and within legal research, it is dogmatic and legal, examining laws, resolutions, and comparative law. It is oriented toward the study of doctrine as a focus for a basic legal analysis that incorporates into notarial law the power to execute deeds by extrajudicial partition before a notary public involving older adults in vulnerable conditions. Finally, based on the information obtained, it is concluded that in Ecuador, liability in notary offices rests solely with the owner, not with public officials who work there. Therefore, notaries, as representatives of the state, are called upon to provide quality service to users, offering guarantees of truthfulness and reliability. |

Therefore, notaries, as representatives of the state, are called upon to provide quality service to users, offering guarantees of truthfulness and reliability.La investigación pretende elaborar un análisis crítico jurídico sobre la responsabilidad penal de los notarios en la celebración de los actos escriturales que se encuentran inmersos los adultos mayores, para que los notarios protegieran los derechos, y no se tratará de beneficiar a una tercera persona en la celebración de actos o contratos. La metodología aplicada fue inminentemente cualitativa a través del análisis de documentos de tipo doctrinales y jurisprudenciales, dentro de las investigaciones jurídicas es de tipo dogmáticajurídica, ya que estudia leyes, resoluciones y derecho comparado, orientado al estudio de doctrina como el enfoque de un análisis jurídico básico que incorpore a la ley notarial la facultad de celebrar actos escriturales por partición Extrajudicial ante notario público que interviene adultos mayores en condición vulnerable.
