الملخص:The research addresses the important role of Notaries in the l lawfulness and authenticity of legal actions, to ensure legal security through the correct application of notarial principles. For instance, one of the notary's faculties is the recognition of signatures on any private document. Consequently, there are promises of the sale of real estate “legalized” through the notarial act of signature recognition. However, it is noted that signature recognition on a promise of sale does not confer legal validity to the document’s content that recognizes the signature and countersignature. This is particularly relevant in the case of promises of real estate sales because, according to Article 1570 of the Civil Code, such promises must be made through a public deed to have legal validity. While signature recognition on a promise of sale is not prohibited, it does not offer the same legal guarantees and does not oblige the parties to the contract. Thus, notaries determine that to provide legal security to users, the promise of sale should be executed through a public deed. Otherwise, the document would lack legal validity and contractual enforceability, leading to consequences such as non-compliance by the parties, damages, inadmissibility of claims, and potential loss of money or property.
