Zusammenfassung:This article examined Habeas Data as a crucial element of the Norma Normarum for defending the privacy of information in the country and analyzed the impact of the digitalization and modernization of the economy. It also studied how privacy and information, within the context of communication and information technologies (ICT), faced new and unimaginable challenges concerning fundamental human rights. The objective was to analyze the jurisprudential references of the Constitutional Court on Habeas Data in the protection of data, specifically in the protection of individuals' rights to know, update, rectify, and delete their information in public and private databases in Santo Domingo during 2024. The research adopted a mixed- method approach (qualitative and quantitative), which included documentary analysis, structured interviews with judges, and surveys of lawyers. The analytical-synthetic, inductive, and deductive methods were employed, with a descriptive and explanatory scope of the normative and jurisprudential evolution of Habeas Data. The ruling No. 55-14-JD/20, which proposed eliminating the requirement of proving harm to access the benefit of Habeas Data, was highlighted as a key element for informational self-determination and the protection of personal identity in the context of the information society. Jurisprudence had strengthened its use, protecting both the information and personal databases, as well as their management by citizens.
