Opis
Sažetak:This research addresses the topic of the principle of public faith in notarial acts in Ecuador, framed within the research line of Notarial and Registry Law in the Ecuadorian legal system. The study emphasizes the importance of the principle of notarial public faith, as it allows acts authorized by notaries to be perceived by the public as authentic and trustworthy. The general objective is to analyze its scope and limitations in the Ecuadorian context, as well as its impact on public trust. A qualitative methodology was used, combining documentary analysis with interviews conducted with practicing notaries, and supported by comparative, inductive, and analytical methods. The study also reveals limited oversight by the Council of the Judiciary and the absence of a standardized model followed across all notaries, leading to inconsistencies. Notarial services are largely concentrated in urban areas, and technological challenges still delay modernization. In countries such as Spain, Colombia, and Estonia, best practices were identified that could be implemented in Ecuador, including the use of technology, continuous training for notaries, and stronger oversight. Strengthening this principle requires more than just legal reforms—it also demands political will, resources, and ethical commitment. Only through these means can the notarial function become more transparent, modern, and inclusive, truly meeting the needs of the country.
